1. Terms of Service

1. About these Terms

These Terms of Service ("Terms") apply to your use of the Wimbledon Brewery website and any purchase of goods or services from us. They form a legally binding agreement between you and The Wimbledon Brewery Company Limited ("we", "us", "our"). By placing an order, creating an account, or using our website, you confirm that you accept these Terms.

Please read these Terms alongside our Privacy Policy, Shipping Policy, and Return and Refund Policy.

2. Who we are

The Wimbledon Brewery Company Limited, a company registered in England and Wales, operates this website. Full company and contact details are in the Contact Information and Legal Notice sections of this document.

3. Age verification and Challenge 25

The products sold on this website include alcoholic beverages. By law, we may only sell alcohol to persons aged 18 or over.

By placing an order you confirm that you are at least 18 years old. We operate a Challenge 25 policy. This means that if the recipient of an alcohol delivery appears to be under 25, the courier will request valid photographic ID (a UK photo driving licence, UK or EU passport, or PASS-approved proof-of-age card). If the recipient cannot produce acceptable ID, the delivery will not be completed and the order may be cancelled and refunded less any reasonable delivery costs incurred.

Alcohol will not be left in a "safe place", with a neighbour, or handed to anyone under 18. An adult aged 18 or over must be present to accept delivery.

Alcohol is sold under Premises Licence number LN/000002946 issued by the London Borough of Merton. The Designated Premises Supervisor is DONNA TRIMMINGS.

4. Placing an order

When you place an order you make an offer to purchase the goods at the prices shown. We will send an order acknowledgement by email. This acknowledgement is not an acceptance of your order. A binding contract is formed only when we send a dispatch confirmation.

We reserve the right to decline or cancel any order, including where:

  • A product is out of stock or has been listed at an incorrect price;
  • We cannot verify that you are 18 or over;
  • We are unable to deliver to the address provided;
  • We reasonably suspect the order is fraudulent or placed for the purpose of onward resale.

5. Price and payment

Prices shown on our website are in pounds sterling and include UK VAT where applicable. Delivery charges are additional and are shown at checkout. We accept payment through the card providers and wallets enabled in Shopify Payments.

Occasionally a product may be listed at an incorrect price. If the correct price is higher, we will contact you before dispatching the order. You may choose to proceed at the correct price or to cancel and receive a full refund.

6. Delivery

Delivery terms, including minimum order values, delivery charges, lead times, and delivery restrictions, are set out in full in the Shipping Policy (Section 3 of this document). The Shipping Policy forms part of these Terms.

7. Cancellations, returns and refunds

Your rights to cancel an order, return products, and receive a refund are set out in full in the Return and Refund Policy (Section 4 of this document). The Return and Refund Policy forms part of these Terms.

Please note in particular that alcoholic drinks and other perishable or sealed-for-hygiene goods are treated as exceptions to the standard 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

8. Allergens, ingredients and responsible drinking

Ingredient, allergen and nutritional information is shown on each individual product page where applicable. In particular:

  • Beers and wines may contain sulphites above 10mg/L, which are declared on the product page and on the packaging in line with retained EU Regulation 1169/2011.
  • Beers are not gluten-free unless specifically described as such.
  • It is your responsibility to check the product page and the product packaging for allergen information before consuming any product.

9. Intellectual property

All content on this website, including text, graphics, logos, images, and the Wimbledon Brewery name and device, is owned by or licensed to The Wimbledon Brewery Company Limited and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, copy, or commercially exploit any of this content without our prior written consent.

10. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to the above, our total liability to you for any loss or damage arising under or in connection with these Terms is limited to the price paid for the goods that gave rise to the claim.

We are not liable for any loss of profits, loss of business, or any indirect or consequential loss.

11. Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay is caused by events outside our reasonable control, including but not limited to extreme weather, industrial action, courier failure, power failure, or acts of government.

12. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. The current version is always available on our website.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause affects your rights as a consumer to bring proceedings in the courts of the part of the UK in which you live.

14. Complaints and consumer rights

If you have a complaint, please contact us using the details in Section 5. You also have the right to use the EU Online Dispute Resolution platform, although as a UK-based consumer you may prefer to raise any dispute directly with us or through Citizens Advice.
